JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-03-2021 The present writ petition has been filed for setting aside the order dated 30.08.2019, passed by the Sub-Divisional Officer, Triveniganj (Supaul), whereby and whereunder the allotment of the Fair Price Shop of the petitioner has been stopped and the consumers of the shop of the petitioner have been tagged with another P.D.S. dealer, on the ground that the petitioner has not deposited challan/ fees for converting his licence under Rule 13(b) of the Bihar Targeted Public Distribution System (Control) Order, 2016.

The respondent-State has filed a counter affidavit and has submitted that the petitioner has not submitted the required challan, which the petitioner is required to deposit, in terms of Rule 13(b) of the Bihar Targeted Public Distribution System

Patna High Court CWJC No.19714 of 2019(2) dt.22-03-2021 2/2 (Control) Order, 2016. It is also submitted that licence fee is required to be deposited under the provisions of the aforesaid Order, 2016, within a period of 08 months, however the petitioner has defaulted in depositing the licence fee. The learned counsel for the petitioner has submitted that the petitioner be granted liberty to rectify her mistake by approaching the District Magistrate, Supaul.

Accordingly, the present writ petition stands disposed of, however with liberty to the petitioner to approach the District Magistrate, Supaul for redressal of her grievances, which shall be redressed in accordance with law. (Mohit Kumar Shah, J) rinkee/- U
