2. The petitioner is in judicial custody in connection with Arwal P.S. Case No. 338 of 2021 for the offences under Section 394 of the Indian Penal Code lodged on 27.09.2021 by the informant, Kundan Kumar.

3. As per the prosecution story, the informant alleged that after closing his shop, they were returning with sales proceed of Rs. 1 lakh and the mobile in a bag, he was intercepted by the accused persons and as he chose not to handover the bag, he was also hit on the head near his eyes and thereafter, it is alleged that they took away the bag.

4. Earlier a report was called for which has since been received vide letter no. 409 dated 06.12.2023 and as per it, charges have been framed against accused persons and four

5. The allegation against the petitioner is grave and he has criminal antecedent of the same nature as reflected from paragraph 3 of the petition. In the aforesaid circumstance, for the present, this Court is not inclined to extend him privilege of bail which is accordingly rejected.

6. In view of the fact that the petitioner has remained in custody for more than two years, the trial court will take up the trial relating to the petitioner on day to day basis, if possible and shall ensure that the same is concluded within a period of six months from today.
