The petitioner seeks bail in a case registered under Sections 28, 27(b)(ii),36(A)(C) of the Drugs and Cosmetics Act. Allegation against the petitioner is of selling drugs without any licence.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 17-07-2019. The petitioner is alleged to have been selling allopathic medicine without any licence. Except for this, there is no other substantive evidence to suggest the implication of the petitioner in the present case. The petitioner was running a charitable service to the Kanbariya who

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Banka in connection with Suiya P.S. Case No. 60 of 2019.
