The petitioner has prayed for bail in connection with Mushahari P.S. Case No. 76 of 2019, G.R. No. 1383 of 2019 registered for the offences punishable under Sections 304B,201,34 of the Indian Penal Code.

As per allegation in the FIR, the informant and other accused persons are said to have made a demand of Rs. Two lac and other articles. It is further submitted that as a result of nonfulfillment of demand of dowry grand-daughter of the informant was tortured and ultimately done to death and the body was disposed of.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.76294 of 2019(2) dt.03-12-2019 2/2 that the marriage between grand-daughter of the informant and son of the petitioner has taken place in the year 2013 and they have three issues from the wedlock. It is further submitted that the allegation against the petitioner is general and omnibus in nature and she is in custody since 18.03.2019. It is further submitted that co-accused has been enlarged on bail vide order dated 18.11.2019 passed in Cr. Misc. No. 70070 of 2019. Having heard learned counsel for the parties and taking into consideration the fact that petitioner being a lady, having no criminal antecedent is in custody since 18.03.2019, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, VIth, Muzaffarpur, in connection with Mushahari P.S. Case No. 76 of 2019/G.R. No. 1383 of 2019.
