2. The petitioner is in custody since 22.06.2023 in connection with Terhagachh P.S. Case No. 46 of 2023 registered for the offence punishable under Sections 302/34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is the husband of the deceased who used to assault the deceased. He is said to have killed the deceased along with other persons.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. The petitioner has no criminal antecedents.

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.68254 of 2023(2) dt.18-10-2023 2/2 and also the allegations levelled against the petitioner, this application for grant of bail is dismissed.
