The petitioner apprehends his arrest in connection with Raniganj P.S. Case No.428 of 2018 registered under Sections 379 and 411 of the Indian Penal Code.

The accusation is that when the informant woke up in the morning of 08.12.2018, she found that her two she-buffaloes were not at the door. In course of search, the informant came to know that her two she-buffaloes have been kept by Sarajul Mian at the bamboo clumps, situated behind his house. Thereafter, the informant went at the house of Sarajul and found her she-buffaloes there. On making query by the informant about her she-buffaloes, his family members started to scuffle with the informant.

Learned counsel for the petitioner submits that, in fact,

No.61788 of 2019(2) dt.15-10-2019 2/2 the she-buffaloes of the informant were recovered from the bamboo clumps, situated behind the house of Sarajul, who disclosed the name of the petitioner as his associate in his confessional statement saying to carry the she-buffaloes of the informant by him. Further submission is that, in fact, the petitioner is accused in three other cases, as detailed in paragraph-3 to this application, in which he is on bail, due to that reason, the police got managed to implicate the petitioner in the present case, showing the confessional statement of the co-accused Sarajul.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Araria, in connection with Raniganj P.S. Case No.428 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
