2. Petitioners apprehend their arrest in connection with Complaint Case No.560 of 2022 instituted under Section 498(A) of the Indian Penal Code and Sections 3⁄4 of the Dowry Prohibition Act.
3. As per the complaint case, the marriage of the
Patna High Court CR. MISC. No.69529 of 2023(2) dt.01-11-2023 2/3 complainant was solemnized with co-accused Pachu Bind and the accused persons including the petitioners have demanded dowry and due to non-fulfillment of the same, they tortured the complainant and kicked out her from the house after snatching her ornaments and clothes.
4. Learned counsel for the petitioners submits that the petitioners are father-in-law and mother-in-law of the complainant respectively and they have falsely been implicated in this case. They are living separately and they have no concern with the affairs of the complainant and her husband. There is general and omnibus allegation made against the petitioners. The petitioners have no criminal antecedent.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Kaimur at Bhabhua in connection with Complaint Case No.560 of 2022, subject to the
Patna High Court CR. MISC. No.69529 of 2023(2) dt.01-11-2023 3/3 conditions as laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
