JUSTICE SANJAY PRIYA ORAL ORDER 28-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Shikarpur P.S. Case No. 514 of 2016 instituted for the offence under Section-307 & other minor Sections of the Indian Penal Code.

As per written report, there is specific allegation against this petitioner of assaulting father of the informant with lathi on the head, on account of which, he died.

C.D. has been received.

In the case diary, the postmortem report is available wherein the doctor has found head injury on the person of the deceased, caused by hard and blunt object, which supports the specific allegation against this petitioner.

Therefore, this court is not inclined to grant bail to the

Patna High Court Cr.Misc. No.31270 of 2017 (3) dt.28-08-2017 petitioner at this stage. Accordingly, prayer for bail is rejected. The petitioner is given liberty to renew his prayer for bail in the court below itself after nine months, if, no substantial progress is made in the case in court below.
