ANJANA MISHRA ORAL ORDER 05-11-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 11.06.2019 in connection with Sadar P.S. Case No. 396 of 2019, registered for the offence under Sections 419,420,467,468 of the Indian Penal Code.

Learned counsel for the petitioner submits that mere recovery of two debit cards from the pocket of the petitioner would not attract the prosecution unless and until it can be said that draws have been made from using the said cards of Ram Sewak Sahni. It is further submitted that apart from the said recovery of debit card recovery of 17,000/- from his pocket was allegedly made but the said money belong to the petitioner. It is

No.61238 of 2019(2) dt.05-11-2019 2/2 further submitted that the other co-accused persons were taken into custody on similar footing have been extended the privilege of bail in Cr. Misc. No. 60461 of 2019 vide order dated 15.10.2019. It is further submitted that the petitioner is not having any criminal antecedent.

Considering the aforementioned facts and circumstances and that the petitioner has clean antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each with to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur, in connection with Sadar P.S. Case No. 396 of 2019, with condition that father of the petitioner will be the bailor.
