2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 8, 18, 20, 22(C) and 23 of the N.D.P.S. Act.

3. As per FIR, total 34250 bottles Codeine rich prohibited cough syrup, 39600 Nitrazepam tablet, 35200 Eudol tablet contains Tepantodal Opium and 88400 Taymol contains Tepantodal Opium was recovered from the house of Khagesh Jha, from the godown of TCI Fridght Godown and from the godown of Agrawal Carrier.

4. It is submitted on behalf of the petitioners that no incriminating article has been recovered from the possession of the petitioners. Petitioners have been made accused in this case

Patna High Court CR. MISC. No.69092 of 2025(2) dt.09-10-2025 2/2 on the disclosure made by the co-accused Gaurav Keshan that he used to procure the said prohibited syrup from M/s Garv Enterprises and Baba Enterprises from the State of Uttar Pradesh. Name of the petitioners surfaced in this case as petitioner no.1 is license holder of Baba Enterprises and petitioner no.2 is husband of petitioner no.1. Petitioners claim clean antecedent.

5. Learned counsel for the State oppose the bail petition.

6. Considering the aforesaid facts, clean antecedent of these petitioners and other circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned District and Additional Sessions Judge-I, Bhagalpur in connection with Tatarpur P.S. Case No. 26 of 2023, subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023.
