JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-12-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 420, 467, 468, 414, 401/34 of the Indian Penal Code .

Petitioner was neither caught on the spot nor anything was recovered from his conscious possession and is only stated that apprehended accused disclosed the name of petitioner revealing this fact that petitioner had come at the place of occurrence to purchase the stolen motorcycle. Moreover, it is informed that petitioner was earlier granted privilege of anticipatory bail by a co-ordiante Bench of this court vide order dated 29.05.2019 passed in Cr. Misc. No. 34887 of 2019 but he could not surrender before the court below in time. As a result

Patna High Court CR. MISC. No.69490 of 2019(2) dt.04-12-2019 2/2 whereof he was compel to file regular bail petition. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Nalanda in connection with Parawalpur P.S. Case No. 191 of 2018.
