JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 17-02-2023 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner apprehends his arrest in connection with Digha P.S. Case No.320 of 2022, registered for the offences punishable under Sections 406, 420, 500, 354(a), 354(b), 376, 511, 504 and 34 of the Indian Penal Code. The petitioner is said to have cheated the informant and his family members on the pretext of marriage of his son. It is also alleged that the son of the informant also tried to establish physical relation with the informant. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner has got no criminal antecedent as stated in paragraph-3 of the bail petition. It is further submitted

Patna High Court CR. MISC. No.65732 of 2022(4) dt.17-02-2023 2/2 that no occurrence, as alleged in the FIR, has ever been taken place and the petitioner is ready to return Rs.10,00,000/- (rupees ten lakhs) to the informant.

Learned counsel for the petitioner has handed over two Demand Drafts (State Bank of India) of Rs.2,50,000/- and Rs.7,50,000/-, bearing nos."053381" and "053382" respectively to the learned counsel appearing on behalf of the informant in Court today and the learned counsel for the informant has accepted the drafts before the Court.

Taking into consideration the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- XIII, Patna in connection with Digha P.S. Case No.320 of 2022, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
