1. Heard the parties.
2. The petitioner apprehends her arrest in connection with RC11(A) of 2016 dated 03.08.2016 registered under Sections 120B, 420, 468, 471 of the I.P.C. and Section 13(2) read with Section 13(1)(d) of the Prevention of Corruption Act, 1988.
3. As per the prosecution case the petitioner has obtained employment as "Gramin Dak Sewak" on the basis of forged educational certificate.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case and the certificate produced by her at the time of appointment was not verified properly. The petitioner has been terminated from service in 2023 and C.B.I. after investigation has submitted charge sheet.
Patna High Court CR. MISC. No.71917 of 2023(4) dt.21-03-2024 2/3 The petitioner co-operated with the C.B.I. during the course of investigation. There is no likelihood that the petitioner will abscond and / or tamper with the evidence.

On the other hand, Mr. Avanish Kumar Singh, learned Special Public Prosecutor for the C.B.I. opposes the prayer for anticipatory bail and submits that pursuant to the order of the High Court in P.I.L. (C.W.J.C. No. 10951 of 2015) the certificates produced by the candidates at the time of appointment was verified and the petitioner and other candidates were found to have produced forged certificate. He, however, submits that C.B.I. has no apprehension that the petitioner will abscond and / or tamper with the evidence.

Regard being had to the submission made by the parties, taking into consideration the fact that petitioner co-operated during the course of investigation, charge sheet has already been submitted and there is no possibility that the petitioner will abscond and / or tamper with the evidence and further the petitioner has been terminated from service, as such, I am inclined to grant anticipatory bail to the petitioner.
7. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on

No.71917 of 2023(4) dt.21-03-2024 3/3 furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, CBI, Muzaffapur in connection with RC 11(A) of 2016 subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
