2. Petitioner apprehends his arrest in a case registered for the offence punishable under section 111 of the B.N.S. and Sections 8(c), 21(b) and 29 of the N.D.P.S. Act. 3 . The prosecution case in brief, is that on a secret information, a raid was conducted and one co-accused Bablu Kumar was apprehended. On search, total 155 grams brown sugar was recovered from a motorcycle. Apprehended coaccused Bablu Kumar disclosed the name of this petitioner as his associate.

4. It is submitted on behalf of the petitioners that petitioner is innocent and has committed no offence as alleged. No contraband has been recovered from the conscious possession of the petitioner. The petitioner has been made

Patna High Court CR. MISC. No.67944 of 2025(2) dt.24-09-2025 2/2 accused in this case merely on the basis of confessional statement of the co-accused Bablu Kumar. The petitioner has got no concern with the motorcycle which was seized on the spot. Petitioner claims clean antecedent.

5 . Learned counsel for the State opposed the bail petition.

6 Considering the aforesaid facts, clean antecedent of the petitioner and other circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge Court No.II, N.D.P.S., East Champaran, Motihari in connection with Nakardei P.S. Case No. 24 of 2025, subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023.
