Petitioner is husband of the opposite party no.2 is apprehending arrest in connection with C.R. No. 260 of 2018, T.R. No. 2939 of 2019 for the offence under section 498(A) of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent.

Allegation against this petitioner is that he has tortured his wife for non fulfilment of the demand of dowry. The marriage took place on 14.3.2014.

Patna High Court CR. MISC. No.62075 of 2019(4) dt.04-03-2020 2/2 Counsel for the petitioner has drawn attention of this Court to para-9 of the petition to the effect that petitioner is ready to keep his wife (opposite party no.2) with full honour and dignity.

Considering the aforesaid statement in para-9 and in order to promote restitution of normalcy in the conjugal life, the Court is inclined to grant anticipatory bail to the petitioner, let the petitioner, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Samastipur, in connection with C.R. No. 260 of 2018, T.R. No. 2939 of 2019 subject to the condition as laid down under section 438(2) of the Cr.P.C.

In the event, the petitioner neglects, misbehaves or torture the opposite party no.2 in future, the Court below shall be at liberty to cancel the bail bonds of the petitioner. (Anil Kumar Upadhyay, J) Ravi/- U
