2. The petitioner seeks bail in connection with Saharghat P.S Case No. 96 of 2025 registered for the offences punishable under Sections 274, 275, 317(5),3(5) of the BNS and section 30(a) of the Bihar Prohibition& Excise Amendment Act.
3. The recovery is of 737.64 liters illicit liquor from three Motorcycles.
4. Learned counsel for the petitioner submits that petitioner is innocent and he is in custody since 23.07.2025. The petitioner has claimed clean antecedent.
5. The learned APP for the State opposes the prayer for bail of the petitioner.
6. Considering the fact and circumstances of the case
Patna High Court CR. MISC. No.65887 of 2025(2) dt.24-09-2025 2/2 and submissions of the parties, let the above named petitioner, be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand)with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, Excise, Madhubani / successor court in connection with Saharghat P.S Case No. 96 of 2025, Subject to the condition that:- (i) This is also subject to the condition that the petitioner shall deposit an amount of Rs. 25,000/- in Ramakrishna Mission Sevashrama, Swami Vivekananda Path, Bela, Muzaffarpur, Bihar and produced the receipt of the same before the court below. The bail bonds of the petitioner shall be accepted after verifying the genuineness of the receipt produced by the petitioner.
(ii) Both the bailors will be local resident of Madhubani.
