Heard learned counsel for the petitioner and learned A.P.P. for the State, Sri Rabindra Kumar. 2.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 447, 379, 504 and 34 of the Indian Penal Code. 3.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that on account of dispute relating to passage, the accused persons including the petitioner came to his house and Vijay assaulted him by gadasa causing injury on elbow of both hands, thereafter co-accused Kaushik Kumar assaulted him by an iron rod, further Kaushik also assaulted his son by an iron rod while Vijay and Prashanjeet (petitioner) had caught his son,

No.65309 of 2025(2) dt.10-02-2026 2/3 thereafter Prashanjeet assaulted his brother by sharp-edged weapon causing injury near his eyebrow, further Reema and Mamta Devi assaulted his brother by an iron rod and Vijay assaulted by sharp-edged weapon injuring his hand and the accused snatched golden chain of the informant. 4.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegations as alleged in the FIR, it would manifest that on account of dispute relating to passage, the occurrence is alleged to have taken place. It is further submitted that on account of dispute relating to passage, an altercation had taken place in which both sides assaulted each other. It is also submitted that the injury suffered by the injured has been opined to be simple in nature. It is submitted that petitioner is not a criminal. 5.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner and taking into consideration the fact that the injures have been opined to be simple, the petitioner above-named, in the event of his arrest or surrender within a period of six weeks from today, be released on anticipatory bail

No.65309 of 2025(2) dt.10-02-2026 3/3 on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Ghorasahan (Lakhaura) P.S. Case No. 494 of 2021 subject to the conditions as laid down under Section 482

(2) of the BNSS.
