A counter affidavit has been filed on behalf of the State of Bihar in which it has been stated that the petitioner has come to this Court without exhausting the remedy of appeal available to him under Section 52A and 52B of the Indian Forest (Bihar Amendment) Act, 1990 and, therefore, the case may be disposed of with liberty to the petitioner for preferring such an appeal.

Learned counsel for the petitioner submits that he is willing to file an appeal agitating his case before the
