JUSTICE MOHIT KUMAR SHAH ORAL ORDER 16-12-2019 At the outset, the learned counsel for the petitioners seeks to withdraw the present petition qua the petitioner no.1, namely, Manjeet Chaudhary @ Manjeet Chaudhary @ Manjeet Kumar in order to enable him to surrender before the learned court below and seek regular bail.

Accordingly, the present petition qua the petitioner no.1 stands disposed of as withdrawn, however, with liberty to surrender before the learned court below and seek regular bail. Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner no.2 apprehends his arrest in connection with Jandaha P.S. Case No. 122 of 2019 for the

Patna High Court CR. MISC. No.67230 of 2019(3) dt.16-12-2019 2/3 offence punishable under Section 307, 379 and other allied sections of the Indian Penal Code.

The allegation is regarding the accused persons having assaulted the informant and her husband resulting in the husband of the informant and others receiving grievous injuries. The learned counsel for the petitioner has submitted that though there is specific allegation of overt act as against the petitioner no.1 of having assaulted the brother-in-law of the informant resulting in him sustaining grievous injury, however, as far as the petitioner no.2 is concerned, a general and omnibus allegation has been levelled against him. The petitioner no.2, namely, Ranjeet Chaudhary @ Ranjeet Kumar Chaudhary is stated to have a clean antecedent.

Having regard to the facts and circumstances of the case, in the event of arrest or surrender in the court below within a period of four weeks from today, the petitioner no.2, namely, Ranjeet Chaudhary @ Ranjeet Kumar Chaudhary is directed to be released on anticipatory bail on furnishing bail- bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali in connection with Jandaha P.S. Case No. 122 of 2019, subject to the conditions laid down under Section 438(2) of the Code of
