The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 354, 354B and 354D of the Indian Penal Code.

Prosecution case is that accused-petitioner Arif Ansari used to say filthy language to the informant's daughter in the way when she was going and he further tried to molest her and gave threatening that if the informant's daughter will not do love with him, he will destroy her. It is further alleged that earlier the complainant has made complaint before the police on 07.11.2017 to which A.S.I. Farid Khan intervened and pacified the matter, but the petitioner continued to do such act. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.65522 of 2019(3) dt.18-12-2019 2/2 petitioner is innocent, has committed no offence and he has been falsely implicated in this case. He submits that petitioner never tried to outrage modesty of the informant's daughter as alleged. He further submits that petitioner has no criminal antecedent. Considering the nature of allegation, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, his payer for anticipatory bail is rejected in connection with Chhatauni P.S. Case No. 212 of 2019, G.R. Case No. 3366 of 2019 pending before the court of the learned Chief Judicial Magistrate, East Champaran at Motihari.

Accordingly, the application is dismissed. However, petitioner is directed to surrender before the court below and prayer for regular bail and the learned court below will consider the bail application of the petitioner on the same day without being prejudiced by this order.
