2. The petitioner seeks bail in connection with Asawn P.S. Case No. 103 of 2025 registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, there is recovery of 1.2 liters of illicit liquor.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 25.08.2025. Nothing has been recovered from the possession of the petitioner.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances,

Patna High Court CR. MISC. No.65476 of 2025(2) dt.24-09-2025 2/2 this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned concerned Court below, Siwan in connection with Asawn P.S. Case No. 103 of 2025.

8. The Exclusive Special Excise Judge-I, Siwan is advised not to reject bail in cases where this kind of small recovery is being made, even if the petitioner has antecedents also.
