The petitioners seek pre-arrest bail in connection with Pakribarawan P.S. Case No. 93 of 2019 registered under Sections 341, 323, 307, 354, 379 and 34 of the Indian Penal Code.

The accusation is that three persons, named in the first information report, including the petitioners, came at the door of the informant, Udai Yadav, and started to abuse. When informant made protest, then, all started to cause assault through lathi and paina in which informant received injury on finger of his right hand and back. When Maheshwari Devi, mother of the informant reached to save the informant, then, petitioners

Patna High Court CR. MISC. No.63357 of 2019(2) dt.21-10-2019 2/2 caused injury through iron rod at left side of her neck. When sister-in-law of the informant rushed to save, then, both the petitioners, with bad intention, tried to outrage her modesty. Submission is that injuries as found on the persons of the mother of the informant are all simple in nature. Both the petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the petitioners, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Pakribarawan P.S. Case No. 93 of 2019 shall be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Diwakar Kumar, Judicial Magistrate, 1st Class, Nawada, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
