The petitioner seeks bail in connection with Special Case No. 43 of 2017 arising out of Vigilance P.S. Case No. 101 of 2017 registered for the offence punishable under Sections 7/13(2) read with Section 13(1)(d) of the P.C. Act. Allegation against the petitioner is of taking bribe. It has been submitted on behalf of the petitioner that the petitioner is innocent and has been falsely implicated in this case due to ulterior motive and biased intention as the petitioner was not ready to fulfil the illegal demands of the informant. It has been further submitted that petitioner was I.O. of Sahebganj P.S. Case No. 16 of 2017 in which the Dy. S.P. has supervised

Patna High Court Cr.Misc. No.7148 of 2018(3) dt.07-03-2018 2/2 the case and found to be false, as such there was no occasion for the petitioner to make a demand of illegal gratification. Petitioner has got no criminal antecedent and is in custody since 18.11.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance, North Bihar, Muzaffarpur in connection with Special Case No. 43 of 2017 arising out of Vigilance P.S. Case No. 101 of 2017.
