Petitioner seeks regular bail in connection with Deo Police Station Case No.92 of 2003 registered for the alleged offences under Section 364/34 of the Indian Penal Code. As per the prosecution case, some unknown miscreants are said to have hired the vehicle of the father of the informant and, later on, kidnapped the driver of the said vehicle along with the vehicle.
It has been submitted by learned counsel for the petitioner that no specific allegations have been made against the petitioner rather the same are general and omnibus in nature. He has been named in the case only on suspicion and village rivalry. He has been languishing in jail custody since 19.02.2016. Similarly situated co-accused persons, namely, Sanjay Yadav and
Patna High Court Cr.Misc. No.32487 of 2017 (02) dt.13-07-2017 2/2 Punam Ram have been granted bail by co-ordinate Benches of this Court in Cr. Misc. No.17140 of 2009 and Cr. Misc. No.410 of 2009 vide orders dated 19.05.2009 and 24.02.2009 respectively. In the facts and circumstances of the case, the petitioner above named is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned Additional Sessions Judge-II, Aurangabad in connection with Deo Police Station Case No.92 of 2003.
