2. The petitioner is in custody in a case registered for the offence punishable under Sections 126(2), 115(2), 303(2), 118, 352, 351(2) and 3(5) of BNS, 2023.
3. As per allegation in the FIR, all the accused persons including the petitioner have assaulted the informant by means of iron rod and specific allegation against co-accused Sanjay Paswan is that he assaulted by sharp cutting weapon on the head of the informant which hit on the upper back side of the head.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the
Patna High Court CR. MISC. No.65712 of 2025(3) dt.26-11-2025 2/2 present case. He next submits that similarly situated co-accused persons have already been granted bail by a Coordinate Bench of this Court passed in Cr. Misc No.65876 of 2025. Petitioner is in custody since 18.07.2025.
5. Learned APP for the State has vehemently opposed the prayer for bail of the petitioner.
6. Considering the facts that similarly situated coaccused persons have already been granted regular bail by a Coordinate Bench of this Court, so let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- ( ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-II, Samastipur in connection with Samastipur Muffasil P.S Case No. 16 of 2025.
