The present miscellaneous jurisdiction application has been filed for initiating a contempt proceeding against the respondents for willful, intentional and deliberate disobedience of the judgment dated 20.02.2017, passed in CWJC No.11196 of 2008.
It is submitted by learned counsel for the respondents that in pursuance to the judgment dated 20.02.2017 passed by this Court in CWJC No.11196 of 2008, the representation of the
Patna High Court MJC No.1824 of 2017(5) dt.19-09-2019 2/2 petitioner has already been disposed of vide order No.8/मुo435/2017 -1098, dated 23.10.2017 issued by the Director, Primary Education, Department of Education, Government of Bihar, as contained in 'Annexure-A' to the show cause filed on behalf of respondent no.3, the Director, Primary Education, Government of Bihar, Patna.
Since the representation of the petitioner has already been disposed of, learned counsel for the petitioner seeks permission to withdraw the present miscellaneous jurisdiction application with a liberty to challenge the order No.8/मुo435/2017 -1098, dated 23.10.2017 issued by the Director, Primary Education, Department of Education, Government of Bihar, as contained in 'Annexure-A' to the show cause filed on behalf of respondent no.3.
Permission is accorded.
Accordingly, the present miscellaneous jurisdiction application stands disposed of as withdrawn with the liberty aforementioned.
