2. The petitioner apprehends his arrest in connection with Parnadabar Excise P.S. Case No. 188 of 2025, registered under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2016.

As per the first information report, on a secret information that two persons are carrying liquor on a motorcycle, the police party was in vigil of them, in the meantime, two persons were spotted carrying a white plastic bag on a motorcycle, however, on seeing the police party, they tried to take a u-turn and escape, but the police party apprehended one of them and the other person fled away. 50 liters of country made liquor and a Hero Splendor Motorcycle bearing Registration No. BR-02BK-9638 were seized.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.66149 of 2025(2) dt.24-09-2025 2/2 name of the petitioner has surfaced in this case on the statement of the co-accused, who was apprehended by the police. It is next submitted that neither the seized article nor the motorcycle belongs to this petitioner and the police party has not followed the process of Section 103 of BNSS. The petitioner has one criminal antecedent, in which he is on bail.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above named, is directed to be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court-2, Nawada, in connection with Parnadabar Excise P.S. Case No. 188 of 2025 subject to the condition as laid down under Section 482 (2) of the B.N.S.S., 2023.
