====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-12-2025 Heard learned counsel appearing on behalf of the petitioner and learned A.P.P. appearing on behalf of the State.
2. The petitioner apprehends her arrest in a case registered for offences punishable under Sections 221, 262, 263, 132, 303(2), 317(2), 317(4), 317(5) and 111 of the B.N.S., 2023.
3. As per the prosecution, the F.I.R. has been lodged against ten named accused persons. It is alleged that during a police raid at the premises of one of the accused, two stolen motorcycles were recovered. Upon a further raid at the premises of another accused, one more stolen motorcycle was found. The police prepared a seizure list of the three stolen motorcycles and arrested two accused persons on the spot. However, subsequently, the remaining accused persons, including the present petitioner, arrived at the scene, created a commotion ("halla"), and assisted the arrested persons in fleeing. They also obstructed the police from performing their official duties.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.65769 of 2025(2) dt.05-12-2025 2/2 allegation is general and omnibus in nature and there is no specific allegation of assault against this petitioner. The petitioner is a lady, and a similarly situated co-accused, Juhi @ Nagma @ Nagama Khatoon, has already been granted anticipatory bail vide order dated 12.08.2025 passed in Cr. Misc. No. 52299 of 2025.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the general and omnibus allegations against this petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest or surrender within a period of eight weeks from today, let the above-named petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of the learned J.M.-1st Class, Araria, in connection with Sikty P.S. Case No. 65 of 2025, subject to the conditions laid down under Section 482(2) of the B.N.S.S. (Prabhat Kumar Singh, J) Neha/- U T
