2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act.

3. The case of the prosecution is that 153 liters of Nepali country made liquor was recovered from a bike.

4. Learned counsel for the petitioner has submitted that the petitioner is quite innocent and has committed no offence as alleged in the FIR. The petitioner has been falsely implicated in this case due to local politics. Learned counsel has further submitted that the petitioner is the owner of the bike bearing Registration No. BR07R-0347 but the petitioner is having no relation with the recovered liquor in this case. The petitioner is a man of clean antecedent and is in judicial custody

5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with G.O. No.742 of 2025 arising out of Benipatti Excise P.S. Case No. 119 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise, Madhubani.
