Petitioner, already in custody, seeks bail in connection with Special Case No.40 of 2016, arising out of Vigilance P.S. Case No.80 of 2016, registered under Sections 7/8/13(2) read with Section 13(1)(D) of the Prevention of Corruption Act. Allegation in brief is that another accused Lokendra Yadav, B.D.O. of the concerned block, demanded illegal gratification asking Rs.25,000/- for accepting the show-cause from a contractual employee and the petitioner is said to be Account Assistant and he is said to be in league with the B.D.O. Learned counsel for the petitioner submits that there is no recovery of the trap money from the possession of the petitioner,

No.12558 of 2018(2) dt.05-03-2018 2/2 rather it was recovered from the rack of the B.D.O's office and petitioner had no role in acceptance of show-cause of the employee and Lokendra Yadav, the concerned B.D.O., has been granted bail by default under Section 167(2) Cr.P.C. Having considered the said facts and circumstances, petitioner Anjan Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance, North Bihar, Muzaffarpur in connection with Special Case No.40 of 2016, arising out of Vigilance P.S. Case No.80 of 2016.
