Petitioner apprehends arrest in a case registered under Sections 302, 201, 120B/34 of Indian Penal Code. Counsel for the petitioner submits that he has falsely been implicated in this case due to dirty village politics. He further submits that there is a delay of 9 days in lodging the first information report for which there is no explanation in the Fardbayan and that the FIR does not disclose the source of information leading to the allegation against the petitioner and other accused persons. As per FIR, the allegation against the petitioner is of committing murder. The allegation is serious in

Patna High Court Cr.Misc. No.32249 of 2017 (2) dt.13-07-2017 2/2 nature and the investigation of the case is still in progress. Nothing has been brought on record that actually the petitioner has been falsely implicated in this case.

Considering the aforesaid facts and circumstances of the case, I am not inclined to grant the privilege of anticipatory bail to the petitioner. Prayer is rejected.
