====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 17-10-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Giriyak (Katarisarai) P.S. Case No.259 of 2019 registered under Sections 419, 420, 467, 468 and 471 of the Indian Penal Code besides Section 66 of the I.T. Act.

The accusation is that on receiving the secret information about doing the work of committing fraud by Bablu Kumar in the association of 4-5 persons at his house, situated in village-Mayapur, the informant along with other police personnel reached there and surrounded the house of Bablu Kumar. On seeing the police party, 45 persons started to flee away but one was apprehended, who disclosed his name Bablu Kumar and also the disclosed the name of three other persons , who succeeded to flee away, including the name

Patna High Court CR. MISC. No.62427 of 2019(2) dt.17-10-2019 2/2 of the petitioner. On search of the house of Bablu Kumar, 11 pieces of the order-sheets of weights and measures with the name of 100 persons and their mobile numbers, Form of 11 filled up page, on line, of the form of Indian Coast Guard and other materials were recovered.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that the petitioner was not apprehended on the spot rather his name was disclosed by the apprehended accused Bablu Kumar. The petitioner has no criminal antecedent. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Nalanda, Biharsharif, in connection with Giriyak (Katarisarai) P.S. Case No.259 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U
