Mr.Sanjay Kumar Tiwary ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 28-03-2023 Heard learned counsel for the petitioner, learned counsel for the vigilance and learned APP for the State.

The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 409, 420, 467, 468, 471, 120(B) of the Indian Penal Code.

As per allegation in the FIR, petitioner has got appointment as Shiksha Mitra by submitting forged educational certificates.

It is submitted by learned counsel for the

Patna High Court CR. MISC. No.670 of 2023(2) dt.28-03-2023 2/3 petitioner that the petitioner is innocent and he has falsely been implicated in the present case. It is submitted via para 6 of the petition that the petitioner has no offence as alleges and he had produced his marksheet as supplied by the Board(BSSB, Patna). He has not made any attempt to submit the forged certificate. As soon as the petitioner came to know the alleged fact, he is about to enquire the matter but by the time, he has been arrested by the police. Moreover, the petitioner is languishing in judicial custody since 15.04.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

Learned APP appearing for the State and learned counsel for the vigilance has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail.
