The petitioner is languishing in custody since 26.06.2019 in a case registered for the offence punishable under Section 306 of the Indian Penal Code.

The prosecution case is that there was some tussle between the petitioner and his mother with regard to dispute of partition of the property on 25.06.2019 at about 8.30 P.M. and consequently, the mother of the petitioner committed suicide. It is submitted by learned counsel for the petitioner even assuming the accusation to be true, the offence of abetment does not make out against the petitioner and a statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent.

Patna High Court CR. MISC. No.61785 of 2019(2) dt.27-11-2019 2/2 Learned APP submits that due to the tussle taken place between the petitioner and his mother, his mother committed suicide.

Considering the nature of accusation and investigation being concluded, coupled with the statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- 1st, Araria in connection with Jogbani P.S. Case No. 182 of 2019.
