JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-09-2019 This is an application for grant of anticipatory bail in connection with Anti P. S. Case No. 71 of 2018, disclosing offence under Section 366 A of the Indian Penal Code. As per F.I.R. the daughters of the informant was called by the petitioner and they along with one Rohit Kumar has taken her daughters to some other place. She is still traceless and statement under Section 164 of Cr.P.C. of one of the victim girl disclosed that the petitioner had called them and all them had gone to Haryana where they have been engaged in a mall and thereafter, petitioner has returned and the said Rohit Kumar has committed rape upon them.
Submission of the learned counsel for the petitioner is that she has also a victim of the circumstances and the allegation is false and concocted and allegation of rape is against one Rohit Kumar. She is ready to abide by any condition imposed

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, surrender before the court below within a period of two weeks from the date of receipt of certified copy of this order, on surrender, she will be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.D.J-I-cum-Special Judge (POCSO Act), Gaya, in connection with Anti P. S. Case No. 71 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that she has to co-operate in the investigation.
