JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-10-2019 This application, for grant of anticipatory bail, arises out of Triveniganj P.S. Case No. 161 of 2019, disclosing offences under Sections 147, 148, 149, 341, 324, 323, 307, 504 of the Indian Penal Code and Section 25(1-b) & 26 of the Arms Act.
As per F.I.R., petitioner and other accused persons tried to obstruct from raising boundary wall and abused the informant. It is further alleged that co-accused assaulted the informant by means of rod and specific allegation against this petitioner is that he assaulted the informant's father by means of butt of country made pistol.
Submission of learned counsel for the petitioner is that there is case and counter case between the parties and land dispute from before and although, there is allegation of assault

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul, in connection with Triveniganj P.S. Case No. 161 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunilkumar/- U T
