2. The present application has been filed for modification application of order dated 04.08.2023 passed in Cr. Misc. No.40602 of 2023, to modify the para-6(i) of the said order, in which it was stated that the bail bond of the petitioner shall be accepted and further one of the bailors will be his own blood relative preferably father, mother, brother, sister and or his wife. A supplementary affidavit is filed by the learned counsel for the petitioner on 07.11.2023 to the extent of extending the period of surrender.
3. It is submitted by the learned counsel for the petitioner that the father and mother of the had died and brother and sister are not ready to be the bailor of the petitioner and the wife of the
Patna High Court CR. MISC. No.74450 of 2023(2) dt.10-11-2023 2/2 petitioner do not have property. Due to such circumstances petitioner has not furnished the bail bond within the fixed period.
4. On the grounds mentioned in the modification application and in the interest of justice, the order dated 04.08.2023 is modified to the extent that any person can file the bail bond of the petitioner and further the period to surrender is extended by six weeks from today in connection with Baikunthpur P.S. Case No.170 of 2023, pending in the court of learned Additional District & Sessions Judge-II-cum-Spl. Excise Court, Gopalganj.
5. The order dated 04.08.2023 is modified to the extent as indicated above.
6. Accordingly, this modification application stands disposed of.
