The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 143, 147, 148, 149, 283, 332, 337, 338, 427, 307, 353 of the Indian Penal Code; Section 3/4 of the Prevention of Damage to Public Property Act and Section 27 of the Arms Act.
As per prosecution case, the allegation against the petitioner along with others is of damaging and burning of the Public Property Act i.e., Train bogy, engine of the passenger train and active station. They further alleged that several police forces received injury.
Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the
Patna High Court CR. MISC. No.66352 of 2022(2) dt.25-02-2023 2/2 present case due to previous enmity. He further submits that the petitioner was identified by the informant through the video footage and the petitioner was also involved in the present case for the damage of such Public Property Act and burning the train and active station. He further submits that the petitioner has no criminal antecedent as mentioned in para-3 of the bail application.
Learned APP for the State opposes the prayer for bail. Considering these facts and circumstances, there is no specific overt act against the petitioner, let the above named petitioner in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Bakhtiyarpur P.S. Case No. 259 of 2022, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Anjani Kumar Sharan, J) Arish/- U T
