2. The present petition has been preferred for the following relief/s:

(i) the present writ application is being filed in the nature of mandamus to direct the respondent authority to stop construction of road nala parking etc over khatiyani land of petitioners without giving notice or giving any award to the petitioner for his Khatyani

3. A counter affidavit has come on behalf of the respondent nos. 3, 4 and 6 and paragraphs 06 to 08 shows that the respondents have taken steps for measurement of the land.

4. In that background, this Court deems it appropriate to dispose of the matter directing the petitioners to approach the Collector, Patna (respondent no.02) in next four weeks who shall be taking steps and ensure that in the presence of an Officer of the Patna Municipal Corporation, the Sub-Divisional Officer, Patna City as also the Circle Officer, Patna City beside the petitioners, the measurement takes place and the report of the Committee headed by the S.D.O., Patna City be placed before him.

5. Once the report comes, hearing be allowed to all the stake holders whereafter decision must come in next three months from the date when the report is submitted in his/her office.

6. With the aforesaid observation, the writ petition is disposed of.
