JUSTICE SANJAY PRIYA ORAL ORDER 18-07-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Cheria Bariarpur P.S. Case No. 195 of 2016 instituted for the offence under Sections 353 and 406 of the Indian Penal Code. From the impugned order it appears that petitioner was granted provisional anticipatory bail by the court below but the petitioner did not surrender within time and complied with the direction given by the court below. Thereafter, on 5.8.2017, a petition was filed by the petitioner for extension of time which was rejected by the court below. Thereafter, this fresh anticipatory bail petition has been filed on behalf of the petitioner. In the facts and circumstances stated above, this Court

Patna High Court Cr.Misc. No.32804 of 2017 (2) dt.18-07-2017 2/2 does not find any fresh ground to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the court below and seek regular bail which shall be disposed off by the court below on the same day in accordance with law after taking into consideration that Sessions Judge has already granted provisional anticipatory bail to the petitioner (Sanjay Priya, J) S.Ali/- U T
