22-06-2018 This case has been notified on urgent motion being made by learned counsel for the petitioner and after the statement made at the bar by Md. Irshad, learned A.C. to S.C.-1 on instruction said to have been received telephonically from the jailor of Beur Jail, Patna that the petitioner is lying ill.

Let the defect be ignored as pointed out by office.

Learned counsel for the petitioner has submitted before this court that the petitioner is only praying before this court for a direction to the learned Special Judge, Excise, Patna to consider his bail application with some urgency considering the fact that the petitioner is

Patna High Court Cr. WJC No.1557 of 2018 (2) dt.22-06-2018 a foreigner (Chineese National).

It appears that the only prayer of the petitioner is for a direction of early hearing of his regular bail petition in Special Case No. 5625/2018 arising out of Gardanibagh P.S. Case No. 231/2018 registered under Section 38(1) &

(2) of the Bihar Prohibition and Excise Act, 2016. Having heard learned counsel for the petitioner and learned counsel representing the State, I would request the learned Special Judge, Excise, Patna to give an early hearing of the regular bail petition and hear the application of the petitioner preferably by Monday i.e. 25.06.2018. The writ application is disposed off accordingly.
