1. Heard learned counsel for the parties.
2. This is an appeal under Section 14-A(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (hereinafter referred to as the "SC/ST Act") against the refusal of prayer for anticipatory bail vide order dated 08.05.2023 in 89 of 2023 passed by the learned 3rd Additional Sessions Judge-cum-Special Judge S.C./S.T. (POA) Act, Bhagalpur in connection with Bhagalpur G.R. P.S. Case No. 294 of 2018 registered under Sections 363, 379, 411, 364, 302 and 34 of the Indian Penal Code as well as Sections 3(2)(v) of the SC/ST Act.
3. In the nature of findings arrived at in the
Patna High Court CR. APP (SJ) No.4507 of 2023(4) dt.22-02-2024 2/2 investigation, the Court is not inclined to entertain the prayer for anticipatory bail as the FIR was instituted by the daughter of the deceased against unknown wherein it was alleged that the deceased had come to Bhagalpur Railway Station and the informant had talked to him till 10:30 p.m. and, thereafter, the deceased went missing. Later on his dead body was found. Accordingly, the FIR was instituted against unknown and during the course of investigation, one Md. Salauddin was arrested who confessed that he along with the appellant was instrumental in causing the death of the deceased.
4. Learned Special Public Prosecutor also opposes the prayer for anticipatory bail.
5. Accordingly, this appeal against refusal of the prayer for anticipatory bail stands dismissed.
6. The interlocutory application, if any, stands disposed of.
