JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Nauhatta P.S. Case No. 47 of 2019, registered for the offences punishable under Section 7 of the Essential Commodities Act.

As per F.I.R. 24 quintals rice was recovered from the tractor of the petitioner and it is alleged that those rice was dealer of P.D.S. shop.

Submission of the learned counsel for the petitioner is that the seized rice is not related with any P.D.S. dealer. Petitioner has kept rice for his personal purpose. Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application allowed. Let the petitioner, above named, in the event of his arrest or surrender before the Court

Patna High Court CR. MISC. No.71440 of 2019(2) dt.08-11-2019 2/2 below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Five Thousand) with two sureties of the like amount to the satisfaction of learned Sub Divisional Judicial Magistrate, Saharsa, in connection with Nauhatta P.S. Case No.-47 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
