JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-08-2017 The petitioner seeks regular bail in connection with Rupauli P.S. Case No. 33 of 2017, registered for offences punishable under Sections 376 of the Indian Penal Code. Allegation against the petitioner is of committing rape on the informant.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and during the course of investigation, witnesses in paragraph 30, 31 and 32 has not supported the case of prosecution and medical report also does not show any sign of rape. Further he has been in judicial custody since 25.04.2017.

Learned counsel for the State opposed the prayer for bail. Having heard both sides, considering the fact and

Patna High Court Cr.Misc. No.32956 of 2017 (4) dt.21-08-2017 circumstances of the case and also the nature of allegation levelled by the prosecutrix against the petitioner, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.
