====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 29-04-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks bail in a case registered for the offences punishable under Sections 366, 341, 323, 504, 506, 307, 447 and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is in custody since 03.09.2022 and is a person with clean antecedent.
The informant alleges that his daughter was married to Sumit Singh, further Biro Yadav after marriage of his daughter enticed and took her away on 28.08.2022, when informant went to ask Anil Yadav about his daughter, it is alleged that accused persons assaulted his cousin brother and co-villager by lathi, rod etc., and petitioner assaulted Ajay and
Patna High Court CR. MISC. No. 68136 of 2022(2) dt.29-04-2023 2/2 Pappu causing injury on head.
The learned counsel submits that petitioner has been falsely implicated in the present case, it is next submitted that no doubt allegation is of assault on head which is vital party of the body but then from perusal of the order impugned it would manifest that the injury suffered is simple is nature. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Parbatta P.S. Case No. 377 of 2022.
