The petitioner is in custody in a case registered for the offences punishable under Sections 30(a) 37 of the Bihar Prohibition & Excise Act, 2018.
Allegedly, it is a case of recovery of 221.800 liters of illicit liquor from a bag.
It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that he has no concern with the seized liquor and no any incriminating article has been recovered from the conscious possession of the petitioner as well as petitioner is in judicial custody since 24.06.2022. Similarly situated co-accused has been granted regular bail by a Co-ordinate Bench of this
Patna High Court CR. MISC. No.69497 of 2022(2) dt.06-01-2023 2/2 Court passed in Cr. Msic. No. 52762 of 2022 and petitioner has clean antecedent.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-II-cum-First Exclusive Special Judge, Excise, Saran (Chapra) in connection with Amnaur P.S. Case No. 178 of 2022.
