The petitioner apprehends his arrest in connection with Naugachia P.S. Case No. 211 of 2019 registered under Sections 30(a)/38(i) of the Excise Act.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Only on the confessional statement of co-accused, petitioner has been made accused. Nothing has been recovered from the conscious possession of this petitioner. Further submission is that petitioner has no criminal antecedent.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the

Patna High Court CR. MISC. No.62249 of 2019(2) dt.17-10-2019 2/2 event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise Act, Bhagalpur in connection with Naugachia P.S. Case No. 211 of 2019, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
