The petitioner apprehends her arrest in connection with Teghra P.S. Case No.135 of 2022, registered for the offence punishable under Sections 366 and 34 of the Indian Penal Code. 3.
The allegation against the petitioner is that she and other co-accused persons kidnapped the niece of the informant. 4.
It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. She has been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. Petitioner is not named in the FIR and there is no specific overt act against the petitioner. She is the sister of the co-accused Md. Shahrukh. Petitioner has no criminal antecedent.

Learned APP for the State opposed the prayer for
Patna High Court CR. MISC. No.69594 of 2024(2) dt.17-10-2024 2/2 anticipatory bail by submitting that the victim in her statement recorded u/s 164 of Cr.PC disclosed that Md. Shahruk took her away from Delhi to Patna, then, Shahrukh's sister i.e. the petitioner and her husband came in a vehicle and put her in that vehicle. They kept her in different places and thereafter left at railway station, Begusarai.

Having regard to the facts and circumstances of the case as well as considering the statement of victim recorded u/s 164 of Cr.PC, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected.
