Learned counsel for the petitioner submits that the writ application has been filed for a direction to respondent No. 2 to consider the application for conversion of the land of the petitioner pertaining to Plot No.1698, Khata No. 367K, Thana No. 02 of Mouza Chausa, Distt. Buxar from agricultural to commercial under the provisions of Section 2 of the Bihar Agricultural Land (Conversion for Non Agricultural Purpose) Act, 2010.

During pendency of the writ application a letter dated 27.12.2022 issued by the learned Sub Divisional Magistrate, Buxar Sadar, requiring the petitioner to deposit a sum of

Patna High Court CWJC No.16827 of 2022(2) dt.17-01-2023 2/2 Rs.4,47,300/- as conversion fee has been filed by the petitioner vide Annnexure-17. Pursuant thereto the petitioner has deposited a sum of Rs.4,47,300/- by Bank Draft in the Nazarat of the Sub Divisional Officer, Buxar Office. Accordingly, he submits that only formal order is to be passed by the learned Sub Divisional Officer for conversion of the land of the petitioner.

In view of the aforesaid submission and the fact that the respondent No. 2 has issued a letter requiring the petitioner to deposit 10 per cent of the value of the land for the purpose of conversion and the petitioner has already deposited the said amount, the Sub Divisional Officer, Buxar, is directed to pass final order within a reasonable period of time preferably within a period of one month.
