2. The petitioner seeks bail in a case registered for the offence punishable under Sections 272, 273, 328, 307, 304, 120B of the Indian Penal Code and Sections 30(a), 37(b), 33, 34 of the Bihar Prohibition and Excise Act.
3. Earlier, prayer for anticipatory bail of the petitioner was permitted to be withdrawn with liberty to him to surrender before the learned court below within a period of six weeks and seek regular bail but the petitioner has surrendered on 21.05.2024 after lapse of one year.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that all the accused persons of this case have already been granted regular bail by a coordinate Bench of this
Patna High Court CR. MISC. No.72086 of 2024(3) dt.10-01-2025 2/2 Court. He further submits that petitioner has three criminal antecedents as stated in para-3 of the bail application and he is languishing in judicial custody since 21.05.2024.
5. Considering the seriousness of offence, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail is rejected in connection with CIS Excise Case No. 735 of 2024 arising out of Nautan P.S. Case No. 415 of 2021. (Anjani Kumar Sharan, J) devendra/- U T
